Alternative Dispute Resolution is a term that describes any method used to settle disputes outside the courtroom. Sometimes noted as ADR, the process includes five methods: neutral evaluation, issue negotiation, conciliation, mediation, and arbitration. While negotiation is typically used as a first method of resolving disputes, the two most popular include mediation and arbitration. Mediation has wider applications, with case types now ranging from federal and state governmental negotiations, juvenile felonies, and issues involving Native American Indian tribes.
