Kristofer’s areas of practice include:
Alternative Dispute Resolution: Kristofer is a Registered Mediator and Arbitrator. He has resolved numerous disputes on favorable terms for clients through negotiation, mediation, and arbitration.
Litigation: Kristofer has litigated a wide variety of business cases in state and federal courts, including commercial real estate litigation, intellectual property litigation (including multi-district patent and trademark litigation and trademark prosecution), and insurance coverage disputes. Has successfully defended and resolved criminal False Claims Act cases and other state and federal criminal healthcare fraud cases. He has also successfully defended or satisfactorily resolved numerous liability and malpractice claims and disputes involving covenants not to compete. He has represented both major employers and plaintiff employees in age discrimination and Title VII litigation. He has successfully represented Atlanta’s taxi drivers in litigation against the City of Atlanta on several occasions, including winning a substantial settlement for the wrongful arrest and impounding of taxis by the City. He is currently litigating wrongful death claims against persons involved in the synthetic marijuana trade.
Administrative Law: Kristofer represents manufacturers, distributors, and service providers in regulated industries and has represented a number of healthcare entities before government administrative agencies. He has also successfully represented professionals before licensing boards, including health care providers.
Business Transactions/Corporate Law: Kristofer provides experienced counsel concerning business formation and development; contracts, mergers and acquisitions; dispute resolution, risk management, shareholder and operating agreements; procuring and negotiating local government contracts; employment agreements and regulatory compliance; and the protection and licensing of intellectual property.
Healthcare: Kristofer has been very successful representing clients accused of healthcare fraud and in the defense of government audits and recoupment proceedings. He provides counsel on reimbursement issues; compliance plans and best practices review; risk management; malpractice defense; government contracts; provider-facility contracts; physician-hospital organizations; provider networks; and employee training, He has helped clients move criminal investigations to the civil and administrative arena or to negotiate pleas when appropriate. He counsels clients concerning HIPAA education and compliance and have been a speaker at the National EMS Management Conference, Georgia EMS Changes conference, and regional health conferences for EMS providers.
He is a graduate of Baylor University with a B.A. in Religion and an M.A. in Sociology. He was admitted as a Ph.D. candidate in Social Psychology at Emory University before enrolling as a Woodruff Scholar at the University of Georgia Law School, from which he graduated cum laude in 1990.
Kristofer has honed his chaos management skills as the father of boy/girl twins and their little sister. He is a cyclist and has run over 50,000 miles since graduating from high school. His interests include religion, politics, and reading. He grew up in North Carolina and Texas but has lived in Georgia for thirty years.
Kristofer is a member of the Texas Bar (2015) and Georgia Bar (1990) and is admitted to practice in all Georgia Courts, the Federal District Court for the Northern District of Georgia, the Eleventh Circuit Court of Appeals, and the United States Supreme Court.
