Our Legal Expertise
LITIGATION
Our litigation team focuses on land-use, construction, real estate, and commercial litigation in federal and state courts as well as before arbitration panels. Our zoning practice includes superior court and appellate practice regarding appeals and challenges to decisions by local officials on zoning applications, variances, special use permits and other land development permits as well as the administrative process leading to such decisions. Our team is at the forefront of zoning law and participated in the drafting of the recent update to the Zoning Procedures Law, O.C.G.A. § 36-66-1 et seq., based on in-court experience with that law.
Our construction law practice focuses on contractor/subcontractor disputes, lien law, construction defects and similar claims for both contractors, subcontractors and property owners. We regularly appear in arbitrations on these matters as well as litigation where we focus our attention not just on the rights being asserted but the practical and economical needs of our clients with respect to such claims.
Our real estate litigation includes every aspect of “dirt law” including defense of condemnations, boundary, quiet title, stormwater, foreclosures, easement disputes and other matters arising out of real estate law. Our practitioners have nearly a century of collective experience in these matters are have been recognized as special masters in their respective communities regarding real estate matters.
REAL ESTATE
Our firm has a comprehensive real estate practice. In addition to representing individuals and small to public land owners, developers, and builders, our attorneys have worked on sophisticated transactions owner-operators, investment managers, private funds, investors, public and private REITs, lenders and borrowers, in structuring and executing a wide range of complex real estate transactions, including: acquisitions, dispositions, financings, joint ventures, real estate funds, real estate development and mergers and acquisitions, real estate financing, landlord/tenant matters including commercial leases, litigation and disputes related to real estate and construction, including zoning, permitting, building code and historic preservation matters, title issues and title insurance coverage, litigation involving nuisance and trespass issues, construction liens and related disputes, commercial dispossessories, condemnation and eminent domain, quiet title actions, foreclosure confirmations, boundary line disputes
ZONING, PERMITTING AND LAND USE REPRESENTATION
In addition to our robust land use litigation practice, our firm has extensive
experience in negotiating the corridors of city and county governments on land-
use, zoning and permitting matters. Whether appearing in quasi-judicial matters
before boards of appeal or legislative maters before elected officials, we are
versed in aiding our clients to prepare the best presentation packages to advance
their interests as well as to prepare such matters for litigation if required.
Our practitioners have extensive experience in this arena and are frequent guest
speakers in continuing education seminars concerning land-use law. They each
bring to the table experience both as lawyers in such matters and as brokers,
sales people, and developers in the real estate industry.
Our firm participated in and assisted with drafting the most recent update to the
Zoning Procedures Law, O.C.G.A. § 36-66-1 et seq. and are frequently consulted
by other practitioners in the field based on extensive appellate work in this field.
